Updated 27 February 2023. 312 Subsection 49(1)(c): Correction reviews Application for review 49(1) Where: … (c) an applicant requests a correction of personal information pursuant to clause 32(1)(a) and the correction is not made; the applicant or individual may apply in the prescribed form and manner to the commissioner for a review of the matter. Subsection 49(1)(c) of FOIP provides that an applicant can request a review where the applicant requested a government institution correct personal information and the government institution decided not to make the correction. Applicants who wish to make a request for review because they are not satisfied with how a government institution handled their correction request, can do so using Form B found in the Appendix, Part II of The Freedom of Information and Protection of Privacy Regulations. The form should be completed and provided to the IPC along with a copy of the government institution’s response to the applicant’s correction request. Any other relevant information, such as other communications with the government institution, can also be attached. The IPC will also accept requests for review that are not on Form B provided the request is in writing and contains the same elements of information as Form B. For the Commissioner to conduct a review, the information must constitute the applicant’s personal information. In addition, the applicant must be able to specify what information is incorrect and why. For more on the right to request correction of personal information, see Section 32 earlier in this Chapter.
