Updated 27 February 2023. 69 (iii) information with respect to the donation by the individual of any body part or any bodily substance of the individual or information derived from the testing or examination of a body part or bodily substance of the individual; (iv) information that is collected: (A) in the course of providing health services to the individual; or (B) incidentally to the provision of health services to the individual; or (v) registration information;192 IPC Findings In Investigation Report 293-2016, the Commissioner found that the information at issue was personal health information and that FOIP did not apply to the information pursuant to subsection 24(1.1) of FOIP. Rather, The Health Information Protection Act applied to the information. In Investigation Report 179-2019, the Commissioner found that, as FOIP did not apply to personal health information, FOIP was not engaged in the circumstances of the case. Subsection 24(1.2) Interpretation 24(1.2) Personal health information in the possession or control of the Workers’ Compensation Board is personal information for the purposes of this Act. Subsection 24(1.2) of FOIP provides an exception to the rule at subsection 24(1.1) noted above.
