Updated 27 February 2023. 192 Subsection 28(2)(i) Disclosure of personal information 28(2) Subject to any other Act or regulation, personal information in the possession or under the control of a local authority may be disclosed: … (i) for the purpose of complying with: (i) an Act or a regulation; (ii) an Act of the Parliament of Canada or a regulation made pursuant to an Act of the Parliament of Canada; or (iii) a treaty, agreement or arrangement made pursuant to an Act or an Act of the Parliament of Canada; Subsection 28(2)(i) of LA FOIP permits a local authority to disclose personal information about an individual without consent for the purpose of complying with an Act or regulation of Saskatchewan or Canada or a treaty, agreement or arrangement made pursuant to an Act of Saskatchewan or Canada. Purpose means the purpose to be attained or the thing intended to be done.524 In this context, it means to comply as required. To comply with an Act or regulation of Saskatchewan or Canada or a treaty, agreement, or arrangement pursuant to an Act of Saskatchewan or Canada, means to act in accordance with or fulfill the requirements of the Act, regulation, treaty, agreement, or arrangement.525 The relevant Act or regulation may not specifically refer to disclosure of personal information.526 However, the disclosure must be for the purpose of complying with the Act or regulation of Saskatchewan or Canada or the treaty, agreement or arrangement made pursuant to an Act of Saskatchewan or Canada. 524 British Columbia Government Services, FOIPPA Policy Definitions at https://www2.gov.bc.ca/gov/content/governments/services-for-government/policiesprocedures/foippa-manual/policy-definitions.
