Updated 27 February 2023. 276 IPC Findings In Review Report 011-2014, the Commissioner considered a request for correction made to the Village of Killaly (Village). The correction request was for a statement in a letter to the applicant from the acting clerk of the Village council. The Village did not make the correctio or make a notation that a correction had been correction. Upon review, the Commissioner found that the Village was not in compliance with subsection 32(2) of LA FOIP. The Commissioner recommended the Village make the correction requested by the applicant and advise the applicant of the correction pursuant to subsection 31(2)(a) of LA FOIP. Subsection 31(2)(b) Right of Correction 31(2) Within 30 days after a request pursuant to clause (1)(a) is received, the head shall advise the individual in writing that: … (b) a notation pursuant to clause (1)(b) has been made; or Subsection 31(2)(b) of LA FOIP permits a local authority to make a notation on file where the decision was made not to correct the personal information. Notation is a note made on the individual’s record by the personal information at issue or in an electronic record indicating that the individual has requested correction of the personal information. A notation should also include the date, who requested the correction, what the requested correction was and a signature or name of the decision-maker.716 Notations should be: • Permanent and obvious • Should include: o The date o The name of the individual that requested the correction o What the requested correction was 716 SK OIPC Guide to HIPA at p. 156.
