The complaint alleged the City was recorded conversation of passengers on public City transit busses using audio surveillance. Upon investigation, the Commissioner found that the City had authority to collect the complainant’s personal information. The Commissioner recommended the City undertake a privacy impact assessment exercise within three months of the issuance of the Report to ensure safety and security, and the PIA could inform policies and procedures that need to be created to ensure that the surveillance is being carried out in the most privacy protective manner. 728 The principles are discussed earlier in this Chapter.
