(2) Prior to receiving the report, a party may request a hearing to make oral representations in a course of a review or investigation. (3) All written or oral representations shall be dealt with by the commissioner pursuant to the confidentiality provisions under section 46 of FOIP, section 48 of LA FOIP or section 54 of HIPA. (4) An oral hearing held by the commissioner may be held virtually or in person and in either case will be recorded for use by the commissioner’s office.
