Part 9.1: Youth Criminal Justice Act – Young Offender This Part sets out the procedure to be followed when a head claims records are covered by the Youth Criminal Justice Act (YCJA) 9.1-1 Claiming records protected by the YCJA (1) Where records are claimed to be protected by the YCJA by the head or delegate, the commissioner’s office will request the head or delegate to provide: a. if the time limit has not expired under section 119 of the YCJA, a copy of the records claimed to be protected by the YCJA, or b. if the time limit under section 119 has expired, an affidavit of records, and a schedule listing the records which are claimed to be protected by the YCJA, setting out the elements requested in the schedule to Form E. (2) Where the commissioner’s office has questions regarding the affidavit of records or schedule, the commissioner’s office will request such clarifying information. (3) The commissioner’s office will not release any record, partial record, or affidavit of records and schedule over which the head has claimed the records are protected by the YCJA, to the applicant, unless the head or delegate submitting the affidavit agrees that the record or affidavit, or a portion thereof, can be shared with the applicant.
