Part 9.2: Claims Under Sections 50 of FOIP, 39 of LA FOIP or 43 of HIPA This Part sets out the procedure to be followed when a head requests that the commissioner discontinue a review. 9.2-1 Requesting a review be discontinued (1) Where the head or delegate is requesting a review be discontinued pursuant to sections 50 of FOIP, 39 of LA FOIP or 43 of HIPA, the commissioner’s office may request the head or delegate to provide a copy of the unredacted record, a submission providing reasons as to why the review should be discontinued and any evidence supporting the reasons given for discontinuing the review. (2) Where the commissioner’s office has questions regarding the record, the submission or the evidence, the commissioner’s office will request such clarifying information. (3) The commissioner’s office will not release any record, partial record, over which the head or delegate has requested that the review be discontinued. (4) The commissioner’s office may decide to: a. discontinue the review and will notify the head or delegate and the applicant giving reasons for the decision; b. treat the request to discontinue the review as a priority matter and issue a report only dealing with the issues raised by the head or delegate in requesting the review be discontinued; or c. deal with the request to discontinue as part of the report that deals with all the issues raised by the head or delegate and the applicant.
